Terms and conditions

These terms and conditions apply to purchases made by consumers on the Inca Living webshop, Inca-living.dk, operated and owned by Inca Living Denmark ApS, Hospitalsgade 10, 8900 Randers C, Denmark, CVR: 34888000. Tlf. +45 73 70 70 20.

1. ORDERING THE PRODUCT

Once you have placed an order on our webshop, you will receive an order confirmation via email as a receipt for the purchase. When your order is dispatched, you will receive an invoice for the purchase along with a shipping/tracking number.

If you haven’t received the order confirmation, please check your spam folder. If you still haven’t received it or have any questions about your order, please contact us at +45 7370 7020 or via email at inca@inca.dk, and we will get back to you as soon as possible.

All communication will be done via email, including order confirmation and invoices.

 

2. PRICES & PAYMENT

All prices on the webshop include VAT and other applicable taxes, unless stated otherwise.

You can pay with VISA, MasterCard, MobilePay, Dankort, bank transfer, and various international cards. The amount will be charged to your card when the product is shipped from our warehouse.

In the case of a bank transfer, you will not be covered by the chargeback rights.

 

3. DELIVERY AND SHIPPING

Inca Living delivers both within Denmark and internationally.

Within Denmark, shipments will be made via GLS or PostNord. For orders shipping outside Denmark, we use DHL Express.

Products will be delivered to the shipping address provided at the time of ordering. Your order will be dispatched as soon as possible and is expected to be sent within 2-3 business days.

Inca Living Denmark ApS is not responsible for delays caused by the courier, weather conditions, inadequate delivery from third parties, or other external factors.

 

4. RIGHT OF WITHDRAWAL

As a consumer, you have a 14-day right of withdrawal when shopping with us.

The withdrawal period expires 14 days after the day you received your goods. If you ordered multiple different items in one order, but they are delivered separately, the period runs from the day you receive the last item.

This means you have 14 days from receiving your goods to inform us that you wish to cancel your purchase. You can send an email to inca@inca.dk or use the standard withdrawal form, which can be found at the end of these terms and conditions.

You cannot cancel the purchase by refusing to accept the goods without informing us.

 

5. RETURNS

Once you have informed us that you wish to cancel your purchase, you have 14 days to return the product to us.

You will need to pay for the return shipping, and you are responsible for any damages during transit.

Condition of the product when returning it:

If the product has decreased in value due to use other than what was necessary to establish the product’s nature, features, and how it works, you can only receive part of the purchase price back. The amount refunded depends on the commercial value of the product and, in some cases, may mean that only shipping costs are refunded.

We recommend that you return the product in its original packaging. If the original packaging is missing, this could lead to a depreciation in the value of the product.

 

Refund of the purchase price:

If you cancel your purchase, you will be refunded the full purchase price. If the product is devalued, we will deduct the amount you are liable for.

We will refund the money using the same payment method you used for the purchase unless otherwise agreed.

We will withhold payment until we have received the returned product.

We only accept packages sent directly to our address.

You can also cancel your purchase by informing us and returning the item personally to the address above, by prior arrangement.

 

6. COMPLAINTS

When shopping with us as a consumer, the Danish Sale of Goods Act applies.

This means you have a 24-month right to claim for defective goods.

If your complaint is justified, you are entitled to either have the product repaired, replaced, refunded, or receive a price reduction, depending on the specific situation.

You must file your complaint within a “reasonable time” after discovering the defect. If you complain within two months of discovering the defect, the complaint is always considered timely.

If your complaint is justified, we will reimburse your (reasonable) shipping costs. The product must always be returned in adequate packaging. Remember to keep the receipt for shipping, so we can reimburse your shipping costs.

 

7. DISPUTE RESOLUTION

If you, as a consumer, wish to complain about your purchase with us, you can submit a complaint to: Center for Alternative Dispute Resolution, Nævnenes Hus, Toldboden 2, 8800 Viborg.

If you reside in a country other than Denmark, you can file a complaint through the EU Commission’s online dispute resolution platform here: http://ec.europa.eu/odr

Inca Living uses cookies to collect information.

 

9. PRIVACY POLICY

We need the following information when you shop with us: Name, address, phone number, and email address. We register and share the personal information necessary to deliver the product to you.

Personal data is registered with Inca Living Denmark ApS and stored for five years, after which it is deleted.

We also collaborate with several companies that store and process data. These companies process the information solely on our behalf and may not use it for their own purposes.

We only work with data processors in the EU or in countries that can provide sufficient protection for your data.

 

10. GOVERNING LAW

These terms and conditions, and any purchase agreement for products from us, are governed by Danish law, excluding Danish choice of law rules and the CISG. The jurisdiction for any legal proceedings is the court in Randers.

 

11. DISCLAIMER AND LIMITATION OF LIABILITY

The webshop reserves the right for any changes in taxes, pricing or proofreading errors, technical errors, out-of-stock items, and force majeure, including labor disputes, epidemics/pandemics, or similar, as well as faults or delays caused by suppliers.
